OPERATION REGULATION OF
HOWMUCH.VN E-COMMERCE PLATFORM

  • GENERAL PRINCIPLES

    Howmuch.vn E-Commerce Platform is established and operated by Rian Soft Co., Ltd. Members on the platform are organizations and individuals, with legitimate commercial activities, who are officially recognized by Howmuch and allowed to use services provided by Howmuch.vn E-Commerce Platform and other related parties. These principles are applied to all the members who use services on Howmuch.vn E-Commerce Platform. Members are free to agree on the basis of respecting all parties involved in selling and purchasing products and services via contracts, without being contrary to the provisions of law. Personal information of members who participate in Howmuch.vn must be clear, complete and accurate. Products, services and promotions on Howmuch.vn E-Commerce Platform has to meet the provisions of relevant laws, and not in the case of business ban and advertising ban according to the law. The selling and buying activities of products, services and promotions through Howmuch.vn E-Commerce Platform must be performed publicly, clearly to ensure consumer rights All contents of this Regulation must comply with the current legal system of Vietnam. All members participating in Howmuch.vn have to study their legal responsibility for the current law of Vietnam and commit to strictly comply with the content in this Operating Regulations of Howmuch.vn E-Commerce Platform.

  • GENERAL PROVISION

    2.1. Domain name of E-Commerce Platform

    E-Commerce Platform and E-Commerce website www.Howmuch.vn is developed by Rian Soft Co., Ltd, the domain name of the platform is www.Howmuch.vn (hereinafter referred to as "Howmuch.vn E-Commerce Platform"). Here are the definitions in E-Commerce Platform

    • Howmuch: Howmuch Management Board
    • E-Commerce Platform: E-Commerce website providing online trading services of Rian Soft Co., Ltd
    • Sales Partner (Seller): a trader, organization and individual registering to open shops to introduce, trading products, provide services, promotional vouchers on the E-Commerce Platform (hereinafter referred to as "Partner").
    • Customer (Buyer): a trader, organization and individual wishing to seek information or purchase products, services or promotional vouchers published on the E-Commerce Platform. Customers are not obliged to register.
    • Member: a trader, organization and individual who wishes to buy or sell products and services on Howmuch.vn, including both Partner and Customer.
    • COD: cash on delivery payment method.
    • Goods: products, services, promotional vouchers provided by Partners via Howmuch.vn E-Commerce Platform.
    • Intellectual Property: any patent, copyright design which are registered or unregistered; rights of registered or unregistered designs, trademarks; services marks or rights of industrial property or other intellectual property and includes applications for any of the above.

    2.2. When you register for a member of Howmuch.vn, Member must understand that

    • Member can create a personal account to use.
    • Member can purchase products and services at the prices and standards according to the commitments of legal traders announced on Howmuch.vn.
    • Member participating in the transaction on Howmuch.vn freely choose the promotions that the Partner posted through the form of vouchers, membership cards which is not contrary to the law.
    • Member shall protect his/her password and monitor the use of his/her account. Member understands and agrees that Member is responsible for all related personal information including the use of their account, and Member has to be completely responsible for any person authorized by Member to access it.
    • All Member’s registered information on Howmuch.vn has to be transparent, complete according to the company's regulations.
  • TRANSACTION PROCESS

    1. 3.1. Process for Customer

      Customer should carefully read the delivery and warranty policies of the Partner in every post. Howmuch recommends that Customer reads the "Feedback" section under each post to find out how reliable the Partner is. When buying goods on the E-Commerce Platform, Customer should follow the following steps

      • Search and refer to the information, prices, and supporting policies of the Partner of the products or services that Customer wishes to purchase; Customer should refer to the product reviews and rating in the product post;
      • Based on the reference information, Customer logins into the account on E-Commerce Platform to start making an order;
      • Customer chooses quantity, options and clicks "Buy now", Customer can select "Add to shopping cart" to continue to select other products and services;
      • Customer provides detailed shipping address, recipient information, methods of payment; Customer selects payment gateway and proceeds with online payment if choosing Online payment;
      • Customer receives products, services;
      • Customer makes inquiries or complaints against Partner (if any)
      • Customer can evaluate the quality of products and services on the E-Commerce Platform
    2. 3.2. Process for Sales Partner

      To register for cooperation and posting information on the E-Commerce Platform, a member who is a Sales Partner should take the following steps

      • Sign up for a "Sales Partner" account: Partner reads and agrees to the terms and conditions of the E-Commerce Platform Policy and provides the information required to complete the registration steps;
      • Login into your Partner account and select "Post Product", select design for your post and fill in required product information and images. After Howmuch verifies product and service information, the post will be published on the E-Commerce Platform.
      • Partner receives the Order information from Howmuch, prepares the products and delivers them to Customer or assigns it to Delivery Agency of Howmuch;
      • Partner performs a return, warranty and coordinates with Howmuch to resolve the disputes (if any).
    3. 3.3. Process of freight forwarding

      After receiving the order, Howmuch will contact Customer to confirm the Order and send the Order information to Partner. Customer must provide accurate information when making registration as a basis for delivery.

      • If the parties agree to use Howmuch's shipping services, Howmuch will send the Delivery Agency to the Partner and ship the product to Customer's registered address.
      • If Partner registers "Seller delivery" service, Partner will be responsible for delivering the product to the Customer's registered address.

      Delivery time and cost depend on the distance between Customer and Partner and the delivery services which Customer choose. If Customer doesn’t receive the product on time that the Partner has agreed upon the order confirmation, Customer can contact the Customer Services Department to report the issues. Howmuch will take action according to the seriousness of the breach.

      Delivery method of Electronic voucher (E-voucher) is different from other products. After ordering and paying 100% of the order value via online payment, the system will automatically send the E-voucher code (including E-voucher code, expiry date, usage conditions & address, total amount paid) via the following forms

      • An SMS to the phone number which Customer registered on the Order
      • The email which Customer used to register their account on Howmuch.vn
      • Order details in Customer's account on Howmuch.vn

      Note: In case Customer changes their phone number/ email account after a successful payment & the E-voucher code has been sent, Howmuch will not be responsible in case of losing information of the E-voucher code.

    4. 3.4. Process of confirming/ canceling the order.

      Howmuch will confirm the Order based on the information Customer provided and send the Order information to Partner. Customer should provide complete and clear information in order to confirm the process faster. Partner will confirm the order (ready or delayed) within 24 hours since Howmuch sent the Order information. Customer can cancel the order by the following ways:

      • Before Partner confirms that the order is ready for delivery, Customer can choose "Cancel Order" in the "Order List" section on the website.
      • After Partner confirmed the order, Customer must call Howmuch Customer Services Center directly, asking for support on Order cancellation.
      • If Customer receives goods and doesn’t use or enjoy any benefits from the goods, they have to follow the Return Policy.
    5. 3.5. Warranty / maintenance process

      Before making Order, Customer should check the warranty, maintenance policies of the product they intend to buy. Howmuch will not be responsible for the warranty of any product. Howmuch will only support within its ability on information reception and communication with Partner so that Customer's product is guaranteed under the policy of Partner. When Partner posting goods, it is important to clearly describe the warranty policy. Partner is responsible for providing warranty services for the product of Customer as in the warranty card. All information provided by Partner/ Supplier is included in the product receipt/bill attached to the package. Customer should keep the warranty card intact and has the right to bring the product to the authorized service centers or warranty centers for warranty service or make a request for maintenance service at home for the fixed product. In case Customer cannot contact Partner, Customer will contact Customer Service Department of Howmuch for assistance. Customer has the right to complain Partner in case Partner refuses to provide warranty service for the product which is under the warranty period and conditions on the warranty card. The warranty conditions are

      • Under warranty period (based on the stamp/warranty card or the activation time of the electronic warranty)
      • Intact Stamp / Warranty card
      • Technically defective products
      • Some cases which may cause a warranty fee

        • Warranty period has expired
        • The product is broken, deformed, burnt, exploded, or engine is humid, etc. which caused by user.

      For promotional vouchers, the warranty/ return policy (if any) is clearly specified on each voucher and will be carried out by the Partner. When there is a need for warranty service, Customer can directly contact the local warranty center (if available). If Customer is too far away from the warranty center or there are any other inconveniences that Customer cannot come directly for warranty, Customer can contact Howmuch for support, we will help to send products for warranty service.

    6. 3.6. Process of returning products

      Step 1: Send request Customer check if return reason is compatible with Howmuch return conditions. Customer signs in Howmuch account and click “Return/Refund” at “Order List” in “My Page” and provide return information as below.

      • Return Reason
      • Detailed explanation of product’s state
      • Photo of the product as proof
      • Request: Replace or Refund

      Step 2: Send back product After the return request is verified, Howmuch will send an email of how to pack product and method for return within 2 work days. Customer will pack product and send via Post Office to the address appointed by Howmuch within 2 work days or Howmuch’s delivery agent will come to pick up product depending on each case. Customer must pack product with full accessories, gift, invoice(if any) as its original package including Return Form provided by Partner Customer needs to keep shipping bill of the returned product as proof that they have sent back the product.

      Step 3: Receive replaced product/ refund amount If the return reason is proved to be valid, Howmuch will make a request to Partner to send the replaced product to Customer within 3 work days or make a refund of the order depending on Customer’s request. Time to deliver replaced product will be the same as the initial delivery time.

      Request for return must be made within return specific period depending on each type of products; Item is not applied with a specific return policy of manufacturer/seller; Returned items must include Return form, VAT invoice (if any) and full accessories as initial delivery (including user manual, warranty card, accessories, original manufacturer box, etc.) and gifts (if any); Reasons for return must be valid and comply with return conditions in the table below

      • Items with E-warranty must not be activated.
      • Tickets, voucher/e-voucher will be applied with Seller’s return policy. All voucher/E-voucher must not be in these conditions to return
        • Voucher is not torn, crumbled, patched up.
        • Voucher/E-Voucher is expired or will expire in a few days
        • Voucher/E-Voucher is used once or more if voucher can be used many times
    7. 3.7. Process of Complaint handling

      Howmuch respects and strictly follows the law provisions about protecting the interests of Customer (Consumers). Therefore, we recommend that Partners posting products or services must provide complete, clear, exact, honest and detailed information related to products, services. All fraudulent actions in business are condemned and take complete responsibility in front of the law. Parties including Partner/ Suppliers, Customer will be responsible for actively handling the issue. It is the responsibility of the Partner to provide written information about what is causing the conflict to the Customer. Howmuch will be responsible for providing information to Customer and Partner if requested by Customer or Partner (related to such dispute). After Partner and Customer have resolved the dispute, they shall be responsible for reporting to the Management Board of Howmuch. In case the conflict happens during the transaction, which is Partner’s fault, Howmuch will take a warning action, lock the account or transfer it to the appropriate legal authority, depending on the level of the breach. Howmuch will terminate and remove all posts about that Partner's products or services on Howmuch and require the Partner to refund to the Customer according to the agreement with the Customer. If the agreement is still not able to solve the conflict arising from the transaction between the two parties, the Customer or Partner will have the right to ask the legal authority to ensure the legitimate interests of the parties, especially Customer.

      Howmuch and Partner are responsible for receiving and handling Customer complaints related to transactions at Howmuch.vn. At the occurrence of a dispute, Howmuch highly emphasizes the negotiation and conciliation among the parties in order to maintain the trust of the members in the service quality of Howmuch.vn. Howmuch's complaint handling process is implemented as the following steps

      • Step 1: Customer can send complaint via email support@howmuch.vn, or call Customer Service Center 086-29-59-759 to report directly to the management.
      • Step 2: Howmuch's Customer Service Department will receive Customer’s complaints. After Howmuch checks the complaint information and collects evidences from the related parties, Howmuch will bring out a clear decision and settlement to Customer and other parties within 7 days.
      • Step 3: Howmuch will send the information to the related parties about the sentence and settlement, monitor the process of handling complaint, confirm the results and proceed to finish the complaint process. In case it’s beyond Howmuch’s authority and jurisdiction, the management will ask the Customer to bring this issue to competent agencies to handle according to law provisions.
  • PAYMENT PROCESSING

    Customer and Partner can refer to the following methods of payment and choose an appropriate method. For E-vouchers, Customer must use online payment method, after the payment is completed, details of the E-voucher will be sent to the Customer via email or telephone.

    • Option 1: Cash on delivery (COD - Delivery and Collection)

      • Step 1: Customer checks for information about products and services;
      • Step 2: Customer makes an order on Howmuch.vn;
      • Step 3: Howmuch confirms Customer information and sends to Partner;
      • Step 4: Partner delivers products via Howmuch or Self-Delivery;
      • Step 5: Customer receives goods, check goods and pay;
      • Step 6: After the complaint period is expired or Customer confirms no complaint, Howmuch makes the payment for the transaction.
    • Option 2: Online payment via credit / debit card: Howmuch accepts payment cards of all banks in Vietnam, provided that they are cards of Visa or MasterCard.

      • Step 1: Customer checks for information about products and services;
      • Step 2: Customer makes an order on Howmuch.vn;
      • Step 3: Customer makes payment online;
      • Step 4: Howmuch confirms Customer information and sends to Partner;
      • Step 4: Partner delivers products via Howmuch or Self-Delivery;
      • Step 6: Customer receives goods;
      • Step 7: After the complaint period is expired or Customer confirms no complaint, Howmuch makes the payment for the transaction.
  • TRANSACTION SECURITY SOLUTIONS

    5.1. Management the information of sellers

    Howmuch uses its services to protect the content which Partner post about their products on Howmuch.vn. In order to ensure that transactions are successfully completed and minimize the risk that may arise, Partner must provide complete information (name, address, telephone number, email, tax code, information products, legal status, etc.) when registering for selling on Howmuch.vn and take complete responsibility for this information. Howmuch reserves the right to review the information provided by the Partner to ensure that the transaction is successful and minimize any potential risks. Partner must ensure that the products they provide are genuine, 100% new, unpacked, unused (second-hand products must be stated clearly), of good quality, legally allowed to trading, and have enough legal documents, same as descriptions on Howmuch.vn and Partner is fully responsible for all of their products

    5.2. Controlling the transactions of Partner

    Transactions of Partner and Customer will be controlled, regularly updated and their prestige will be rated by Howmuch.

    5.3. Note for Customer

    Before placing an order, Customer should carefully and thoroughly refer to product information, warranty policy, return delivery, method of payment and delivery applied and check all the reviews that previous customers have made. As soon as Customer clicks on "Buy Now", Customer's browser enters safe mode. Data related to the order of Members, Customer's personal information and payment details will go through all Howmuch's servers as an encrypted form. As soon as the order is complete, Customer should leave the safe mode. Customer should not reveal the details of payments to anyone by email or any other forms of contact, Howmuch is not responsible for damages or risks Customer may incur in exchanging information through any forms of contact. Any fraud and unauthorized use of your payment card by someone to purchase, we will refund the money we received from you only if you inform to the Card Issuer and contact us immediately when you find out that your Payment Card cannot be used. Customer absolutely does not use any programs, tools or other forms of interference to the system which make changes to the data structure. It is strictly prohibited to distribute, promote or encourage any activity that interferes with, destroy or intrude the website system. All acts of violation shall be handled according to this Operating Regulations and the provisions of law. All transaction information is confidential, except when required by the Regulatory Authority.

  • PROTECT YOUR PERSONAL INFORMATION

    6.1. Purpose and scope of collection

    The main data collection on Howmuch.vn includes email, phone, username, login password, Customer (member) address. This is the information that Howmuch requires members to obligatory provide when registering for services and in order that Howmuch contact to confirm when registered members use services on Howmuch.vn E-Commerce Platform to ensure the interests of consumers. In the process of transaction and payment on Howmuch.vn, we only save the details of paid orders of members, the information about members’ bank account will not be saved. Members will be individually responsible for the security and retention of any use of the services with their username, password and email box. In addition, the member is responsible for informing immediately to the management board of Howmuch.vn E-Commerce Platform about illegal use, abuse, security breach, retain the name and password of the third parties to bring out the appropriate measures.

    6.2. The scope of using information, the Howmuch.vn uses members’ information provided to

    • Providing services to members;
    • Send notification about information of transaction activities between members and Howmuch.vn;
    • Personalize content whenever Customer visits Howmuch.vn, based on genders, ages, location, interests, purchase history, product pages customer viewed.
    • Analyze consumer trends with the purpose of developing new services, or improving the old ones.
    • Prevent activities that destroy member account or fake members;
    • Contact and handle issues with members in special cases.
    • In case there is a legal requirement. Howmuch.vn is responsible for providing personal information of members when required by the judicial authority, including the investigation of Procuracy, the Court, the Departments of Public Security related to Customer’s violation. Otherwise, no one has the right to infringe on members’ personal information.

    6.3. Information storage time

    Members’ personal data will be kept until it is required to be canceled or member logins and cancels by themselves. In other cases, personal information of members will be secured on the server of Howmuch.vn.

    6.5. Tools for users to access and edit their personal data

    Members have the right to self-check, update, modify or cancel their personal information by logging into the account and editing personal information or asking Howmuch to do so. Members have the right to submit a complaint to the Board of Directors of Howmuch.vn about the disclosure of their personal information to third parties. When receiving these responses, Howmuch will confirm the information, be responsible for answering the reasons and guide the member to recover and protect their privacy. Phone number: 086-29-59-759.

    6.6. Commitment to confidentiality of customer personal information

    Members’ personal information on Howmuch.vn is committed to having absolute security according to privacy policy of Howmuch.vn. The collection and use of each member’s information shall be made only with the agreement of the Customer unless otherwise stipulated by law. Do not use, transfer, distribute or reveal to third parties any personal information about a user without his/ her agreement. In cases the server is attacked by hackers resulting in personal data loss, Howmuch.vn will be responsible for reporting the matter to related departments to investigate immediately and informing the results to members. Keep absolute security of all online transactions’ information of members including the digital certificate of account information in the safe central data level 1 of Howmuch.vn. Howmuch.vn require individuals, who are Howmuch’s members when registering / purchasing must provide full personal information such as full name, contact address, email, telephone number, identity number, account number, payment card number and so on, be responsible for the legality of the above information. Howmuch.vn is neither responsible nor resolve any complaints related to that member's interests if all the personal information of that member is provided upon initial registration is incorrect.

  • PROTECTING USERS’ INTERESTS

    Customers have the right to submit a direct complaint and compensation request to Howmuch in case the product or services provided by Partner does not guarantee the quality as published information. Howmuch always ensure to support Customer compensation request to Partners who provide products and services in order to ensure legal interests of consumers in cases there are transactional conflicts affecting the Customer’s interests.

  • RESPONSIBILITY IN CASE OF ARISING TECHNICAL ERRORS

    8.1. Regulation for members

    Members will be individually responsible for the security and retention of any use of the services with their username, password. The member is responsible for informing immediately to the management board of Howmuch.vn E-Commerce Platform about illegal use, abuse, security breach, retaining username and password of a third party to bring out an appropriate solution. Members do not use the services of Howmuch for the purpose which is illegal, unreasonable, fraudulent, threatening, unlawful information exploration, sabotage, creating and/ or spreading of harmful viruses to the network, configuration, transmitting Howmuch’s information or use their services for speculative purposes, rigging the market to create fake orders, including for the purpose of forecasting market demand. In case of violation, members shall be held accountable to the law. Members are not allowed to alter, modify, assign, copy, distribute, deliver, or create the similar of services provided by Howmuch E-Commerce Platform to a third party without the agreement of Howmuch Trade Platforms in this Regulation. Members shall not bring Howmuch into discredits in any forms, such as disuniting the members by using a second registration name, through a third party, or propagating information which is not good for the prestige of Howmuch E-Commerce Platform.

    8.2. Prohibited behavior in publishing information on Howmuch.vn

    • Ads infringing intellectual property rights.
    • Create posts with the same content (spam).
    • Other acts which infringe on advertising law.
    • Post information that contains links to other websites.
    • Ads with unfair competition according to the law of competition.
    • Ads that harm the prestige, honor, dignity of organizations or individuals.
    • Post information, images that are sensitive, political, religious, crack, hack, website advertising.
    • Ads which are lacks of aesthetic, contrary to Vietnam’s traditional history, culture, habits and customs
    • Ads using images, words and handwriting of individuals without their agreement, except permitted by law
    • Publish personal information, contact information in the posts’ content, product photos and the Partner’s shop.
    • Use a curious sensational product title for the viewer, title does not clearly show the product name, services, title makes Customer misunderstood.
    • Capitalize all the content of postings, use Vietnamese without diacritical marks or strange characters which causes aesthetic loss and cause difficulties to readers.
    • Ads using the method of direct comparison of prices, quality and efficiency of using products, goods and services with prices with the same types of other organizations and individuals.
    • False ads or causing misunderstanding about the business ability or ability of providing products of organization or individual who trade products, goods or services; about the quantity, quality, price, utility, design, package, trade-mark, origin, type, services method and warranty period of products, goods or services already registered or already to be announced.

    8.3. List of prohibited products

    The below list may be updated whenever there is any change in the applicable laws or the community report.

    • Drugs and stimulants.
    • Animals and all animal products
    • All types of alcohol, strong alcohol;
    • Any food that is harmful to human health
    • Rare flora and fauna and other living things
    • Human beings and human organs, body parts
    • National confidential documents of any form.
    • Cosmetics of unclear origin, origin, used cosmetics
    • Weapons, guns, ammunition, pepper spray, explosives or toxic chemicals;
    • Cigarettes, cigars and other finished tobacco products;
    • Any medicines, vaccines, antibiotics, chemicals and bio-preparations;
    • Goods with the characteristics of racism or offensive to any ethnic or a certain country.
    • Invalid product/software or unlock programs
    • Stolen products
    • Spy devices, mobile jammers;
    • Personal information
    • Products infringe trademarks, copyrights.
    • Currency, credit and debit cards, stocks, shares, all types of stocks and seals
    • Badges, medals, uniforms or anything related to the Government, Police or Military
    • Illegal services such as prostitution, gambling
    • Lottery tickets, gambling machines
    • Depraved tapes, disks, books
    • Dangerous toys that may affect personality education or health of children
    • Any cultural products with content of reactionary, depravity, superstition, or threatening the education of personality and aesthetics
    • Relics, artifacts, antiquities, national treasures

    8.4. Conditional transacted products according to the current law provisions

    To conditional transacted products according to the current law provisions, Partner trading on Howmuch must provide and comply with complete documents and procedures to publish products on Howmuch.vn.

    8.5. Mechanism for reviewing and controlling products/services information of the E-Commerce Platform Management Board for products/services posted on the Howmuch E-Commerce Platform

    When applying for a shop on Howmuch, Partner needs to send the information about the legal entity or the Certificate of business registration. When a Partner publishes a product or service information, Howmuch's censorship department will check the information posted within 24 hours. After verified, valid posts will be displayed, violated pots will be deleted. Products that do not suitable with the category will be removed or will be moved to another category that Howmuch thinks reasonable. Howmuch reserves the right to decide on the retention or removal of any post on Howmuch.vn without prior notice.

  • RIGHTS AND OBLIGATIONS OF HOWMUCH E-Commerce PLATFORM MANAGEMENT BOARD

    Howmuch.vn commits to ensure the safety and stability of the entire technical system. However, in case of an error caused by Howmuch, Howmuch will immediately take measures to ensure the interests of the Customer.

    When performing transactions on Howmuch Platform, members are required to strictly follow the instructions. Howmuch's Management Board commits to provide the best quality of services to its members. In case of technical errors, software errors or other objective errors leading to members cannot participate in the transaction, members notify the Management Board of the errors via email support@Howmuch.vn, we will fix the errors in the shortest time, assist members participating in Howmuch E-Commerce. However, Howmuch Management Board will not be responsible for resolving any issues that the notices from members do not reach the Management Board, resulting from technical errors, transmission errors, software or other errors which are not caused by the Management Board.

  • RIGHTS AND RESPONSIBILITIES OF MEMBERS PARTICIPATE IN HOWMUCH E-COMMERCE PLATFORM

    10.1. Rights of Howmuch E-Commerce Platform Management Board

    Promulgate required procedures and conditions for members, users of Howmuch E-Commerce Platform; In cases where there are grounds to prove that the information provided to Howmuch E-Commerce Platform is inaccurate, incomplete or in violation of Vietnamese laws or customs, the Howmuch Management Board shall have the right to refuse, pause or terminate the right to use our services of members; Howmuch Management Board may terminate membership and use of one or all of member services in the event that a member violates the regulations of the Howmuch E-Commerce or behaviors affect Howmuch E-Commerce Platform business activities; Howmuch Board of Management can terminate the right to use the services and membership of members if Management Board found members have fraudulent activities, forgery, causing market disorder, causing losing unity to other Howmuch members, violating the current laws of Vietnam. Howmuch Board of Management holds the right to use the services and content on Howmuch E-Commerce Platform according to the laws on the protection of intellectual property in Vietnam. All logos, content in different languages are owned by Howmuch E-Commerce Platform. All acts of copying, using and illegally disseminating such ownership rights are strictly forbidden. Howmuch Management Board reserves the right to change the table, services tariff and method of payment during the period providing services to the members on the demand and conditions of the Howmuch E-Commerce Platform and will give the members notice before 1 (one) week. Howmuch.vn will consider the termination of rights to use the services and membership if the member does not participate in transaction and exchange information on Howmuch.vn E-Commerce Platform in 01 (one) year. If you want to continue to become a member and get the right to use the services, you must register again in the forms and procedures of Howmuch.vn. Howmuch.vn Management Board can immediately terminate the right to use the services and the membership right if the member is found bankrupt, sentenced or in the sentence, if the member continues to operate can cause legally responsible for Howmuch.vn E-Commerce Platform, having fraudulent activities, forgery, causing market disorder, causing losing unity to other Howmuch members, violating the current laws of Vietnam. In the case of termination of membership rights and the right to use the services, all certificates and membership rights will automatically be null and terminated.

    10.2. Obligations and Responsibilities of the Management Board of Howmuch.vn

    Register and set up Howmuch.vn E-Commerce platform in accordance with the law and publish the registered information. Develop and publicize operating regulations on Howmuch.vn E-Commerce Platform in accordance with the law; to monitor and ensure the implementation of this Regulation. Develop and implement a "supervisory and inspection mechanism to ensure that the information provided by Partner on Howmuch.vn is fully and accurately implemented" in accordance with the provisions of Clause 4, Article 36 of Decree No. 52 / 2013 / ND-CP. Examine and verify registration information for participation in selling goods or providing services on Howmuch.vn. Establish mechanisms to allow users to join in Howmuch.vn, implement the process of entering into contracts as stipulated in Section 2 of Chapter II of Decree 52/2013 / ND-CP. Be responsible for building Howmuch.vn E-Commerce Platform, including a number of key tasks such as research, design, purchase hardware and software, connect to the Internet, develop services policy for the operation of Howmuch.vn E-Commerce in permitted conditions and areas; Implement and cooperate with Partner in building a system of services and tools for transactions of participating members and users on Howmuch.vn. Management Board of Howmuch.vn will conduct promotion activities, promote Howmuch.vn E-Commerce Platform to foreign markets in permitted conditions and areas, contribute to expand, connect to meet the needs of looking for Partner and develop foreign markets of members joining Howmuch.vn. Maintain registration information of members from the date of registering to join in Howmuch.vn E-Commerce and regularly update the relevant information changed; Apply necessary measures to ensure the safety of information related to business secrets of members. To not reveal, transfer, lease or sell information related to business secrets or personal information of consumers without the agreement of related parties, unless otherwise stipulated by law; Prevent and remove information on counterfeit goods, illegally copied goods, illegally imported goods, goods violated intellectual property rights, goods and services on the list of goods and services prohibited business by law and goods which restricts as stipulated in Clause 1, Article 3 of Circular No. 47/2014 / TT-BTTTT and other law-breaking goods and services when being detected or receiving feedback about acts constituting a breach on E-Commerce Platform. Remove from E-Commerce Platform Information Requests Partner who sell goods and services on the list of conditional goods and services on Howmuch.vn from E-Commerce Platform must provide the certificate of fulfillment of business conditions for those goods and services (in case the law requires a certificate of fulfillment of business conditions). Provide information and support to state management agencies to investigate violations of the law on the use of Howmuch.vn. To provide information about their business situation at the request of competent state agencies for E-Commerce statistical activities, inspection and examination and handling of violations. To publicize the dispute settlement mechanism arising in the transaction process on Howmuch.vn. When Customer on Howmuch.vn E-Commerce Platform has conflict with Partner or infringed their legitimate interests, Howmuch.vn Management Board is responsible for being a go-between in the mediation if any dispute arises between Customer and Partner. The Management Board will receive feedback and complaint from Customer and check those feedbacks and complaints. If the feedbacks are correct, the Management Board of Howmuch.vn will ask the Partner to explain that information. Depending on the level of violation, the Management Board of Howmuch.vn will have a plan to resolve or request Partner to compensate for Customer, closing the account of the Partner. To take responsibility of third parties for supplying information on goods and services to consumers according to the provisions of the Law on Protection of Consumers' Interests. Maintain the normal operation of Howmuch.vn E-Commerce Platform and quickly overcome the problems that affect the operation of the E-Commerce Platform such as technical problems of machinery, software errors, Internet, human resources, social upheavals, natural disasters, power outages, decisions of state agencies or a third party. In the event of force majeure such as natural disasters, fire, social upheavals, decisions of functional agencies ... outside the control, Howmuch.vn is not responsible for joint responsibility.

    11.1. Rights of Member Howmuch.vn

    Create booths to post product information, services and conduct business transactions as well as promote your business on Howmuch.vn. Provide a separate registration name and password to use our services, control booths and transactions on Howmuch.vn. Be guided to use the tools, necessary features to serve the construction of booths, conduct transactions and use services on the Howmuch. Enjoy incentive policies and participate in promotional programs provided by Howmuch.vn or other third parties on Howmuch.vn. These promotional policies and programs will be posted directly on Howmuch.vn or directly sent to Members. Send feedback to Howmuch.vn in the process of operation by sending a proposal directly by mail, email or call directly to the supporting department of Howmuch.vn.

    11.2. Obligations of Member Howmuch.vn

    Provide necessary information related to yourself to ensure completion of the order including transaction name, address, method of payment, telephone contact. Take responsibility for the confidentiality and retention of all uses of the services under their own name, password and email. Members are responsible for immediately inform to Howmuch.vn about illegal use, abuse, breach of security, keeping their names and passwords for cooperation. Commit that information provided to Howmuch.vn and information posted on Howmuch.vn is accurate and will be updated as soon as changes. Members are generally responsible for the content posted, the behavior and principles of conduct when participating in the transaction on Howmuch.vn. Take responsibility for the content, images of Business and other information as well as the whole process of trading with Partner on Howmuch.vn. All members including Partner and Customer are responsible for providing information about transaction and merchandise, support to Howmuch.vn E-Commerce Platform in resolving disputes between Partner and Customer taking place on the Platform. The Partner is responsible for paying damages to Customer if it can be proven that the fault belongs to the Partner. The Partner is responsible for the information of the promotion as well as promotional policies and information related to promotional products. Partner must comply with commitments on the quality of goods and services that are promoted according to the information provided. Partner is responsible for the entire contents of copyright, images, information provided and must provide full information in accordance with regulations from Article 30 to Article 34 of Decree No. 52/2013. / ND-CP and is responsible for the accuracy and truthfulness of information about goods and services sold on Howmuch.vn. Partner must comply with the provisions of the law on making online order when handling the transaction on Howmuch.vn, which is specified in Section 2, Chapter II of Decree No. 52/2013 / ND. -CP; Partner must provide information about their business situation at the request of competent state agencies for E-Commerce statistical activities; Partner must comply with the law on payment, advertising, promotion, protection of intellectual property rights, protection of consumers' interests and other relevant laws when selling goods or provide services on E-Commerce Platform and fulfill all tax obligations as guided by law Comply with legal provisions on information provision and entering into contract on Howmuch.vn and the provisions of this Regulation.

  • TERMS OF USE

    Howmuch.vn has officially come into effect since the date of signing the Decision issued with this Regulation. Howmuch reserves the right and may change this Policy by posting on Howmuch.vn to announce to its members. The revised Regulation is effective from the effective date of this Decision. Members continue to use the services after the revised Regulation is made and enforced means that they have accepted this revised Regulation. The Regulation will be updated continuously by Howmuch continuously without prior notice. Members of Howmuch.vn are responsible for complying with current regulations when trading on Howmuch.vn.
